Actor Trisha Krishnan settles dispute out of court; Madras High Court ordered refund of court fee

Actress Trisha Krishnan has reached a compromise with her neighbor over a dispute over possible structural damage to her property and hence, the Madras High Court has ordered the refund of court fees paid by her while filing a civil suit earlier this year.

Justice RMT Tika Raman settled the matter after recording a joint settlement memo signed by Ms Krishnan and her neighbor Mr Mayappan and his wife Ms Kaveri and their lawyer. He directed the High Court Registry to refund the court fee as per rules.
The actor had filed the case in January this year seeking a permanent injunction against his neighbors on Cenotaph Road Second Lane in Chennai from carrying out any further demolition or construction on the east wall affecting the structural stability of his property.
On January 24, Justice N. When his interim injunction application was listed before Satish Kumar, the judge took note that there was a common wall between the actor’s house and his neighbour’s house and both the buildings were built by the former owners of the property.
The actor bought his property in 2005, his neighbors bought theirs in 2023 and started demolishing their buildings to redevelop the property. The common wall posed a challenge because of the potential for damage to the plaintiff’s property, he said.
“Considering the nature of the residential property as described more fully in the application schedule where the two units are built in an area that was built by the predecessors in title and the pipes leading to the over head tank and drainage system are laid in common. Supporting both unit wall and common wall, the view of this Court is that if the common wall is demolished or damaged without taking adequate steps and safeguards to prevent the possibility of damage to the property, the case would be the same. Serious consequences such as collapse of the structure,” the judge wrote.

He also granted the interim injunction after observing: “It is the view of this Court that the petitioner has established that there is a prima facie case for granting the interim injunction of the advertisement and if the respondents are not restrained by the interim injunction there is. Potential for peripheral injury to the applicator. The balance of benefits is also in favor of the petitioner.”
Thereafter the period of interim injunction is extended from time to time. Meanwhile, the actor’s mother and his neighbor appeared before the High Court on March 21, 2024 and efforts were made to settle the case out of court. Efforts are fruitful and disputes are settled amicably.
